The legal concept of “take-home exposure” is common in asbestos litigation, but a recent California decision may open the door for employer liability for ‘take home exposure’ for COVID-19. In See’s Candies, Inc. v Superior Court, 2021 Cal App Lexis 1076, a ‘take home exposure’ lawsuit was allowed to proceed despite other caselaw to the contrary. With spiking cases of COVID-19, should employers be concerned about their liability in these cases? What can they do to best protect themselves from these types of lawsuits?.
