"Immigration and Customs Enforcement (ICE) placed detainers on approximately half a million individuals during fiscal years 2012 and 2013, according to the latest government records obtained by the Transactional Records Access Clearinghouse (TRAC) at Syracuse University under the Freedom of Information Act. Of these detainers, half were issued on individuals who had not been convicted of any offense, while only 12 percent were for those who had been convicted of a serious (Level 1) offense.
In some states the proportion of detainers issued against individuals with criminal records was significantly larger than 50 percent. In Missouri, 74 percent of ICE detainers were issued on individuals without any criminal record. Alabama was second with 73 percent never convicted, followed by Kansas with 71 percent. Among states with the lowest percentages of detainers based on criminal conviction were Idaho (29%), Virginia (34%) and Connecticut (35%).
The variation among facilities was even wider: the fraction of detainers issued against individuals with criminal convictions ranged from a low of 1 percent to a high of 95 percent for facilities with over 1,000 detainers in fiscal years 2012 and 2013.
