USA v. Ideal Transportation, Nov. 17, 2016- "I find that in the exercise of discretion, the proposed penalty in this case should be reduced to $200 for each of the nine violations involving an employee with a TWIC Card, and $300 for each of the three violations involving an employee without a TWIC Card, for a total penalty of $2700. Consistent with OCAHO case law, and for all of the abovementioned reasons, Ideal Transportation is the type of small business enterprise that should benefit from penalty mitigation and the general public policy of leniency toward small business entities, as set forth in the Small Business Regulatory Enforcement Fairness Act."
