"The Immigrant & Refugee Appellate Center, LLC, is pleased to release the first monthly update to the 2015 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through Feb. 11, 2015.
Among other newly added cases, the Index now contains decisions:
• Holding that Dent v. Holder, 627 F.3d 365 (9th Cir. 2010), provides noncitizens an “absolute right” to view the contents of their A-file
• Holding that Md. Crim. Law, Code Ann. 7-104 is not divisible and thus is categorically not an aggravated felony “theft” offense
• Holding that disclosure and use of another’s Social Security number under 42 U.S.C. 408(a)(8) not a crime involving moral turpitude
• Holding that ICE officers need not engage in physical brutality to commit an “egregious” Fourth Amendment violation
• Holding that an immigration judge should have granted a continuance to await a response to a FOIA request
