"The Immigrant & Refugee Appellate Center, LLC, is pleased to release the most recent update to the 2015 edition of the Index of Unpublished BIA Decisions, which now contains decisions issued through August 11, 2015.
Among other newly added cases, the Index now contains decisions:
• Terminating proceedings with prejudice under Mellouli v. Lynch, 135 S. Ct. 1980 (2015), against a respondent convicted of possession with intent to use drug paraphernalia under N.C.G.S. 90-113.22
• Reversing the discretionary denial of an adjustment application where the immigration judge relied on allegations in a pre-sentence investigation regarding a prior offense for which the respondent was never charged
• Holding that a respondent who arrived 30 minutes late did not fail to appear for his hearing
• Denying an interlocutory DHS appeal challenging the grant of a motion to change venue filed by a detained respondent
