The Board of Immigration Appeals welcomes interested members of the public to file amicus curiae briefs discussing the below issue:
ISSUES PRESENTED: (1) Is a determination of marriage fraud in a prior visa petition proceeding alone sufficient to deny a subsequent visa petition submitted on behalf of the same beneficiary in a subsequent visa petition proceeding, or is the USCIS District Director obligated to conduct an independent determination as to whether there was a prior fraudulent marriage?"
