Using Bankruptcy to Duck Mass Torts Just Got Harder Podcast
The Third Circuit recently ruled that the consumer products giant Johnson & Johnson can't create an entity to spin off billions of dollars of liability (relating to consumer lawsuits claiming Johnson & Johnson’s talc product contained traces of harmful asbestos) and then have that entity file for bankruptcy protection.
