- California: The Second Appellate District of the California Court of Appeal holds that where an arbitration agreement specifies that it is governed by the Federal Arbitration Act (FAA) and does not expressly elect California law, the FAA preempts Cal. Civ. Proc. Code § 1281.97, which requires a finding of material breach and waiver of arbitration rights when an employer fails to timely pay arbitration fees. The court noted other state appellate court decisions holding that the FAA does not preempt the California law. See Hernandez v. Sohnen Enters., Inc., 2024 Cal. App. LEXIS 330 (Ct. App. May 22, 2024).
- New Jersey: The New Jersey Supreme Court holds that amendments to the state's Wage Payment Law and Wage and Hour Law that added enhanced damages and extended the statute of limitations must be applied prospectively to conduct that occurred on or after August 6, 2019, not retroactively to conduct that occurred before that date. See Maia v. IEW Constr. Grp., 2024 N.J. LEXIS 439 (May 15, 2024).
- Vermont: Vermont requires employers with at least five employees to include a pay range in written job advertisements. See 2024 VT H.B. 704.
