On April 23, 2024, the U.S. Department of Labor enacted a rule increasing the salary threshold for “white-collar” employees to be exempt from receiving overtime from $35,568 to $43,888 on July 1, 2024, and then an increase to $58,656 on January 1, 2025. - Federal: The Supreme Court holds that an employee challenging a job transfer under Title VII must show that the transfer brought about some harm with respect to an identifiable term or condition of employment, but that harm need not be significant. See Muldrow v. City of St. Louis, 2024 U.S. LEXIS 1816 (Apr. 17, 2024).
- New York: The Second Circuit holds that under New York's "impact test," the New York State Human Rights Law does not apply to employment discrimination claims brought by a Virginia-based employee working remotely in New York. The court found that the "lion's share" of alleged discriminatory conduct was directed at the employee in Virginia and that any discriminatory impact in New York was incidental. See King v. Aramark Servs., 2024 U.S. App. LEXIS 6601 (2d Cir. Mar. 20, 2024).
