- Federal: The Supreme Court holds that the traditional four-factor test for a preliminary injunction articulated in Winter v. Natural Resources Defense Council, Inc., 555 U. S. 7 (2008), governs the NLRB's preliminary injunction requests under Section 10(j) of the National Labor Relations Act. See Starbucks Corp. v. McKinney, 2024 U.S. LEXIS 2603 (June 13, 2024).
- California: The Ninth Circuit Court of Appeals holds that California's A.B. 5 is constitutional and rational in its application to app-based transportation companies and affirms a district court's dismissal of plaintiffs' state and federal Equal Protection claims. See Olson v. California, 2024 U.S. App. LEXIS 14034 (9th Cir. June 10, 2024). Note: in a pending case, Castellanos v. State of California, No. S279622, the California Supreme Court is considering the constitutionality of Proposition 22, California's voter-approved ballot measure that exempts app-based rideshare companies and delivery network companies from A.B. 5 and allows these companies to classify app-based drivers as independent contractors.
