Round Table Files BIA Amicus Brief: Pro Se Respondent

On June 28, 2024 the BIA invited amici to brief the following question: "What is the scope of the Immigration Judge’s duty to develop the record for a pro se respondent? See, e.g., Arteaga-Ramirez v. Barr, 954 F.3d 812 (5th Cir. 2020); Matter of J-F-F-, 23 I&N Dec. 912, 922 (A.G. 2006); Matter of S-M-J-, 21 I&N Dec. 722, 723-24, 28-29 (BIA 1997); see also Quintero v. Garland, 998 F.3d 612, 623-26 (4th Cir. 2021) (discussing possible sources of authority for such a duty). Is this duty affected by individual characteristics of the respondent, such as education level or language ability?"

The Round Table of former IJs and BIA Members filed this brief, authored by former IJ Hon. Jeffrey S. Chase.

"Jeffrey S. Chase is an immigration lawyer in New York City.  Jeffrey is a former Immigration Judge and Senior Legal Advisor at the Board of Immigration Appeals. He is the founder of the Round Table of Former Immigration Judges, which was awarded AILA’s 2019 Advocacy Award. Jeffrey is also a past recipient of AILA’s Pro Bono Award. He sits on the Board of Directors of the Association of Deportation Defense Attorneys, and Central American Legal Assistance."
