The LexisNexis® In-House Legal & Compliance Conference returns in the physical event format, taking place on 2 December 2022 (Friday) in Asia Society, Hong Kong.

With the theme 'From Legal Strategies to Business Opportunities', the 2022 conference gathers hundreds of senior in-house legal and compliance professionals and C-suites from across Asia. With the rich legal experience of our renowned speakers, this conference explores the legal issues and business opportunities posed by the global economy and regulations, and discusses how corporate counsel could formulate their internal legal strategies to bring more value to their businesses.

  • Competition Law Primer and Practical Tips for In-House Counsel
    • Philip Monaghan, Partner, O'Melveny
    • This session explores the basics of competition law for every corporate counsel, such as the prohibitions, the penalties, the policies and the procedures. Compliance tips would be provided on the rules or guides to the pitfalls of multijurisdictional merger control to manage the process, such as when and where might the company need to file. Recent changes of the PRC Anti-Monopoly law and hot topics in international antitrust would also be covered.

  • Data Transfer Restrictions in Digital Economies
    • Stephen Kai-yi Wong, Barrister-at-Law, former Privacy Commissioner for Personal Data, Gilt Chambers
    • This session would explore the laws of EU, US, Mainland China and Hong Kong for data and global digital economies, such as GDPR, PDPO and PIPL etc. The relevant government guidelines and court cases would be discussed in details to shed light on the treatment of transfer of sensitive personal information, especially for cross-boundary data flow between Mainland and HKSAR. Areas of focus such as consent, reasonable precautions, due diligence and exemptions would be covered. For the latest development of ESG in data-driven economies, insights would also be shared on how to enhance organizations' advice and delivery for clients, and mitigate the related risk factors.

  • Practical Tips on Engagement with Counsel and Management of Multi-jurisdictional Dispute Resolution

    • This session would explore the role of counsel on specific legal and evidentiary aspects of disputes and the differences between the expectation of corporate client and what counsel could realistically offer. The scope would cover multinational dispute resolution starting from drafting documents to winning cases. Areas of focus such as litigation forum, choice of law, establishing jurisdiction and service of proceedings, challenging jurisdiction, managing parallel jurisdiction, interlocutory proceedings etc. would be covered.
  • The Changing Role of In-house Counsel in Modern Corporations – Thoughts on Risk Management on IP Rights and Disputes Resolution
    • Winnie Tam SBS, SC, JP, Barrister-at-Law, Head of Des Voeux Chambers, Des Voeux Chambers
    • This session would explore the challenges faced by modern corporations, such as economic and geopolitical risks, compliance requirements, policy changes, ethical challenges, citizenship demands etc. Against such background, the role of in-house counsel is critical in changing from a reactive role to a proactive role in business partners leadership, internal governance, risk management and mitigation, transactions and disputes. Risk management in relation to IP rights and disputes would be covered, such as species of rights and registration, trade name, domain name abuse, concept of territoriality, protecting non-registrable rights, preparing for disputes, productions of documents and protecting confidentiality etc.
