New York Jury Awards $13 Million To Visitor Whose Fall On Apartment Stairs Caused Fractured Ankle, Career-Ending Injuries
2265 Davidson Realty LLC owned an apartment building at 2265 Davidson Avenue, Bronx, NY. Langsam Property Services Corp. managed the property. On May 8, 2013, Aminata Kromah, a 32-year-old woman, went to the building to visit a friend. She stated that her left foot became caught on a broken and unlit stair tread, causing her to fall five feet to the landing. She reportedly suffered a tri-malleolar equivalent fracture and dislocation of her left ankle. She spent six days in the hospital and underwent surgery with open reduction and internal fixation and extensive hardware implanted. After her release, she suffered complications, including traumatic arthritis, arthrofibrosis, and complex regional pain syndrome/reflex sympathetic dystrophy, complicating her recovery and causing additional pain. She underwent additional surgery and extensive rehabilitation. She claimed that she suffered from constant pain, limited mobility, and requires a cane to ambulate. She also claimed that she was unable to return to her previous occupation as a hairdresser. Kromah asserted that 2265 Davidson and Langsam Property knew that the stair was in disrepair and had replaced several other steps over the six months leading up to her accident.
On June 14, 2013, Kromah filed an action in the Supreme Court of the State of New York, County of Bronx, asserting claims of negligence against 2265 Davidson and Langsam Property and seeking damages for her injuries.
The action proceeded to a jury trial before Justice James Hubert. On April 6, 2017, the jury returned a verdict in favor of Kromah, awarding her $13,000,000 for her injuries.
