Rowe v. Pacific Quad, Inc. Faculty Version

"Looks like you're getting a little behind in your work," James Schmit, operations manager at Pacific Quad, said to the new hire, Alice Rowe. "I'd sure like to get a little behind in mine." Rowe sues Pacific Quad for sexual harassment, claiming this and other lewd behavior at Pacific Quad created a hostile work environment and forced her to quit. She previously had filed a claim against a professor when she was in college. There are three witnesses for both the plaintiff and the defendant.

Frederick C. Moss
- Frederick C. Moss is professor emeritus of Law at the Southern Methodist University School of Law, where he has taught since 1978. Born in Washington, D.C., Moss received his J.D. from Villanova University in 1968. After serving as an officer in the U.S. Army from 1969 to 1971, and a federal prosecutor in the District of Columbia from 1971 to 1975, he attended Harvard Law School as a graduate teaching fellow, receiving his LL.M. in 1977. The following year, he taught at Harvard as a lecturer in law and ran Robert Keeton's mini-NITA course for the Harvard law students. In 1978, Moss came to SMU, where he teaches evidence, ethics, trial practice, and criminal law. Moss was the director of NITA's Southern Regional Basic Trial Skills Program for nine years. Currently, he is the director of the Southern Deposition Training Program since 1991. His publications include "Beyond the Fringe: Apocryphal Rules of Evidence in Texas," 43 Baylor L. Rev. 701 (1991); "Opening the Door to Extrinsic Offenses Through Misleading Blanket Statements," 18 Voice for the Defense 14 (1989) (Texas Criminal Defense Lawyers Association); "The Sweeping-Claims Exception and the Federal Rules of Evidence", 1982 Duke L. David B. Oppenheimer
- David B Oppenheimer is a Clinical Professor of Law and the Director of Professional Skills at Berkeley law (Boalt Hall). Following his graduation from Harvard Law School, Professor Oppenheimer clerked for California Chief Justice Rose Bird. He then worked as a staff attorney for the California Department of Fair Employment and Housing, prosecuting discrimination cases, and was the founding director of the Boalt Hall Employment Discrimination Clinic. Professor Oppenheimer has presented scholarly papers on discrimination law at many universities, including Harvard, Yale, Stanford, Columbia, Duke, Oxford, the Paris Institute of Political Science (Sciences-Po), and the University of Paris, and at the annual meetings of the Association of American Law Schools and the American Political Science Association. He has published articles on discrimination law in the Pennsylvania Law Review, the Cornell Law Review, the Columbia Journal of Human Rights Law, the Berkeley Women's Law Journal, the Berkeley Journal of Employment and Labor Law, Droit et Cultures, and others. Oppenheimer is a co-author of the casebook Comparative Equality & Anti-Discrimination Law (Foundation Press 2012), and was a contributor to MacKinnon and Siegel's Directions in Sexual Harassment Law (Yale University Press 2003) and Friedman's Employment Discrimination Stories (Foundation Press 2006). His co-authored book, Whitewashing Race: The Myth of a Color-Blind Society (with M. Brown, M. Carnoy, E. Currie, T. Duster, M. Schultz and D. Wellman) (University of California Press 2003) won the 2004 Benjamin L. Hooks outstanding book award. He is the author of the NITA trial file, Rowe v. Pacific Quad, which was developed in the 1980's for the Boalt Hall Employment Discrimination Clinic, and is now in its fourth edition. The trial file was adapted as a depositions file by Fred Moss of Southern Methodist University in 2000. Oppenheimer & Moss are now collaborating on two fully integrated co-authored Rowe files, one for trial programs and one for deposition programs.
