Large Securities Litigation

The Challenge
When a large financial services corporation with more than 20,000 employees faces securities litigation, the stakes are high. With the case filed in the so-called “rocket docket” in U.S. District Court in the Eastern District of Virginia, the typical challenges of discovery in large litigation are compounded. The Top 20 law firm hired to represent the company turned to Applied Discovery for assistance.

The Case
The legal team had an East Coast client with data stored in numerous locations around the country. They collected more than 1.5 million pages of electronic documents from 29 custodians, and delivered the data to Applied Discovery on DVDs, CDs, and hard drives. Facing tight deadlines and a large volume of information, it was critical for the team to be able to search, review, categorize, and produce responsive documents in the most efficient manner possible. They knew a traditional “paper review” would not be an option in this case.

Search functionality was critical to the legal team. Identifying documents by file extensions became a key component of their review methodology. The ability to pinpoint certain document types (.xls, .ppt, .pst, .doc, etc.) within this large set of data allowed the team to review and categorize common document types together. They also relied heavily on the ability to store and re-run queries as new documents were added to the database.

Capacity - Meeting the Demands of the "Rocket Docket"
With the case filed in the jurisdiction known as the "rocket docket," the legal team needed professional assistance to complete discovery on the tight timeline mandated by the court. Applied Discovery started processing the company's electronic documents on a Monday, and had the first set of 500,000 pages available for Online Review within 48 hours. The firm had more than 20 reviewers in 3 offices around the country accessing the Web-based database. Within two weeks, the legal team was producing responsive documents to opposing counsel in PDF form on CD. The production schedule required twice-weekly exports with 24-hour turnaround times until the project was complete.

The pace of this case was even more frenetic than usual for large litigation. To get to just the necessary documents quickly and efficiently, the Account Manager from Applied Discovery's Client Solutions Group collaborated with the legal team by conducting brainstorming sessions to develop strategies and methodologies at the onset that would guide them throughout the project.
